Der Wandel zu einer nachhaltigeren und emissionsärmeren Gesellschaft und Wirtschaft hat sich in den letzten Jahren zu einem beherrschenden Thema unserer Zeit entwickelt. Den Banken kommt dabei eine Schlüsselrolle zu. Zum einen ergeben sich aus dem enormen Finanzierungsbedarf Chancen, zum anderen haben sich Nachhaltigkeitsrisiken für viele Institute zu einem wesentlichen, aktiv zu steuernden Risikotreiber entwickelt. 
  
Im ersten Teil des Seminars werden Sie für die Bedeutung des Themas und die Rolle der Banken sensibilisiert. Es wird auf den EU-Aktionsplan „Sustainable Finance“ und das Ziel, Kapitalflüsse in ökologisch nachhaltige Aktivitäten zu lenken, eingegangen. Voraussetzungen dafür sind unter anderem, dass ein einheitliches Verständnis besteht, was als „ökologisch nachhaltige Aktivität“ gilt, und dass nachprüfbare Kriterien geschaffen werden, die eine Einstufung einer Aktivität als ökologisch nachhaltig ermöglichen. Mit der EU-Taxonomie und begleitenden Regulatory Technical Standards werden diese Voraussetzungen geschaffen. Darüber hinaus wird auf die Corporate Social Responsibility Directive (CSRD) und deren nationale Umsetzung in Deutschland sowie die Vorgaben für die Säule III Offenlegung als wesentliche Elemente der Nachhaltigkeitsberichterstattung eingegangen. 

Teil 2 des Seminars beinhaltet einen Ü;berblick über regulatorische Vorgaben zum ESG-Risikomanagement für Banken. Nachhaltigkeitsrisiken wurden von der BaFin mit dem Ende 2019 erschienenen Merkblatt als ESG-Risiken (Environmental, Social & Governance) in den bankaufsichtsrechtlichen Anforderungskatalog integriert. Auch die EZB-Bankenaufsicht hat mittlerweile Vorgaben zum Umgang mit Klima- und Umweltrisiken veröffentlicht und prüft deren Umsetzung bereits als Teil des SREP. In Deutschland sind zahlreiche Vorgaben zum ESG-Risikomanagement seit dem Jahr 2023 Bestandteil der Mindestanforderungen an das Risikomanagement (MaRisk) und somit Teil der Jahresabschlussprüfung sowie aller bankaufsichtlichen Prüfungen nach § 44 KWG. Mittlerweile liegen auch zahlreiche neue Vorgaben an das ESG-Risikomanagement und die ESG-Offenlegung auf Basis der neuen CRR und CRD vor, darunter unter anderen Anforderungen an das CO2-Accounting und so genannte Transitionspläne. Zudem sind zahlreiche weitere Regelungsinitiativen auf internationaler und nationaler Ebene zu beachten insbesondere die neuen EBA-Leitlinien zum ESG-Risikomanagement, das Lieferkettensorgfaltspflichtengesetz in Deutschland und die neuen EU-Vorgaben im Rahmen der Corporate Sustainability Due Dilligence Directive (CSDDD).
