Rechtssichere Wärmeplanung nach dem WPG

Nach dem Entwurf des Wärmeplanungsgesetzes (WPG) müssen die Länder sicherstellen, dass auf ihrem Hoheitsgebiet Wärmepläne erstellt werden. In Städten mit mehr als 100.000 Einwohnern müssen die Wärmepläne spätestens bis zum 31. Dezember 2025 vorliegen; kleinere Gemeinden haben bis Ende 2027 Zeit. Um die Wärmeplanung zu erstellen, dürfen Dritte beauftragt werden. Im Rahmen der Durchführung der Wärmeplanung sollen die Öffentlichkeit und die Träger öffentlicher Belange beteiligt werden. Bestandteile des Wärmeplans sind Potenzialanalyse, Zielszenario, Einteilung des Gebiets in Wärmeversorgungsgebiete, Darstellung der Versorgungsoptionen für das Zieljahr 2045 und Umsetzungsmaßnahmen. In diesem Praxisseminar geht Rechtsanwalt Dr. Clemens Antweiler zunächst auf die vergaberechtlichen Schritte vor Beauftragung der Wärmeplanung ein. Neben den rechtlichen Möglichkeiten und Grenzen in der Wärmeplanung erörtert er zudem, wie eine Wärmeplanung ordnungsgemäß umgesetzt wird und welche Aspekte die Bauleitplanung beachten muss. Zum Abschluss geht er auf die möglichen Fördermittel nach der Richtlinie KliWaVo ein.
